2. Domain Availability

Important: The listing of a domain on our website does not guarantee its availability. Domain availability is confirmed only when:

• The purchase price has been agreed upon by both parties
• Payment has been secured in escrow
• The domain transfer has been initiated

We reserve the right to remove listings at any time without notice. Domains may be sold to other buyers while negotiations are ongoing unless a binding agreement has been reached.

3. Pricing and Offers

Prices displayed on our website are indicative and may be subject to negotiation. For domains listed as "Make Offer":

• All offers are non-binding until accepted in writing
• We reserve the right to accept, reject, or counter any offer
• Submitted offers do not create an obligation to sell

All prices are in United States Dollars (USD) unless otherwise specified.

4. Payment and Escrow

All domain transactions are processed through Escrow.com, a licensed escrow service. The payment process works as follows:

• Step 1: Buyer and seller agree on a purchase price
• Step 2: Buyer deposits funds into escrow
• Step 3: Seller initiates domain transfer
• Step 4: Buyer confirms receipt of domain
• Step 5: Funds are released to seller

Escrow fees may apply and are typically shared between buyer and seller unless otherwise agreed. You agree to comply with Escrow.com's terms of service when using their platform.

5. Domain Transfer

Upon confirmation of payment in escrow, we will initiate the domain transfer process. Transfer timelines vary depending on:

• The domain registrar(s) involved
• The top-level domain (TLD) requirements
• Any transfer locks or restrictions on the domain

Most transfers complete within 24-48 hours, though some may take up to 7-10 business days. We will keep you informed throughout the process.

6. Buyer Responsibilities

As a buyer, you agree to:

• Provide accurate contact and payment information
• Complete payment within the agreed timeframe
• Have an active account with a domain registrar to receive the transfer
• Respond promptly to transfer authorization requests
• Confirm receipt of the domain within the inspection period

7. Seller Responsibilities

As a seller (where applicable), you agree to:

• Have full ownership and authority to sell the domain
• Ensure the domain is free of liens, disputes, or encumbrances
• Initiate transfer promptly upon escrow confirmation
• Provide accurate transfer authorization codes
• Remove any transfer locks prior to initiating transfer

8. Limitation of Liability

To the maximum extent permitted by law:

• PremiumDomains.now is not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount paid for the specific transaction in question
• We are not responsible for disputes between registrars or technical transfer issues beyond our control
• We make no guarantees regarding the future value, traffic, or revenue potential of any domain

9. Dispute Resolution

In the event of a dispute:

• Parties agree to first attempt resolution through good-faith negotiation
• If negotiation fails, disputes may be submitted to mediation
• Payment disputes are handled according to Escrow.com's dispute resolution procedures

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in The Netherlands.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services following any changes constitutes acceptance of the new Terms.
